1. Introduction and Agreement

These Terms of Service ("Terms") govern your access to and use of Hard Money Lenders of San Jose (the "Site"), operated by Lead Skills, LLC ("we," "us," or "our"). By accessing, browsing, or submitting an inquiry through the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

We may update these Terms at any time. Material changes will be indicated by an updated effective date. Your continued use of the Site after an update constitutes acceptance of the revised Terms.

2. Our Role: Lead Generation Service

The Site is a marketing and lead-generation service. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions.

When you submit an inquiry, we share the information you provide with one or more participating hard money lenders who may contact you about financing. All credit decisions, including loan approval, denial, rates, terms, and funding timelines, are made solely by the participating lender. Submitting an inquiry does not guarantee that you will be matched with a lender or that any lender will offer you a loan.

3. No Offer or Solicitation

Nothing on this Site constitutes an offer to lend, a commitment to lend, or a solicitation for any specific loan product. Information about loan programs, rates, timelines, or features reflects general possibilities available through participating lenders and is subject to change without notice. Actual terms depend on borrower and property qualification by the participating lender.

4. Eligibility

To use the Site and submit an inquiry, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal authority to enter into these Terms on your own behalf or on behalf of any entity you identify.
• The information you provide is accurate, current, and complete.
• You are submitting your own contact information or information you are authorized to submit on behalf of the person or entity identified.

5. Your Consent to Be Contacted

When you check the consent box on our inquiry form and submit the form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry.

Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any text or calling 408-886-9962. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Lenders of San Jose connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Submit information that is false, misleading, or not yours to submit.
• Attempt to gain unauthorized access to the Site, related systems, or user data.
• Interfere with or disrupt the Site, including through the use of viruses, scrapers, bots, or automated systems (except for well-behaved search-engine crawlers).
• Reproduce, distribute, modify, or create derivative works of any content from the Site without our prior written permission.

8. Intellectual Property

The Site and its content, including text, graphics, logos, images, design, code, and compilations, are owned by us or our licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use to evaluate whether to submit an inquiry. All other rights are reserved.

9. Third-Party Links and Services

The Site may link to third-party websites or services, including those of participating lenders. We do not operate, control, or endorse those third parties, and we are not responsible for their content, policies, or practices. Your dealings with any participating lender or other third party, including any loan negotiations, agreements, and disputes, are solely between you and that third party.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

WE MAKE NO WARRANTY THAT YOU WILL BE MATCHED WITH A PARTICIPATING LENDER OR THAT ANY LENDER WILL OFFER YOU A LOAN. WE DO NOT WARRANT THE ACCURACY OF INFORMATION PROVIDED BY PARTICIPATING LENDERS OR OTHER THIRD PARTIES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A PARTICIPATING LENDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your submission of information, your breach of these Terms, or your violation of any law or the rights of any third party.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and we agree that any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Santa Clara County, California, and we each consent to personal jurisdiction and venue in those courts.

14. Changes to These Terms

We may update these Terms from time to time. Updates become effective when posted. We will update the "Last Updated" date below to reflect the most recent revision. Your continued use of the Site after the effective date means you accept the updated Terms.
