Hard Money Lenders of San Jose (the "Site") is a lead-generation website operated by Lead Skills, LLC ("we," "us," or "our"). We are not a lender. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. Instead, we collect information from consumers interested in hard money financing and share that information with participating lenders who may contact the consumer about their inquiry.

Because our service involves collecting nonpublic personal information from consumers seeking financial products, we treat that information as protected under the Gramm-Leach-Bliley Act ("GLBA") and applicable state financial privacy laws. This Privacy Policy explains what we collect, how we use it, how we share it, and the choices you have.

2. Information We Collect

• Operate the Site and process your inquiry as a lead-generation service.
• Connect you with one or more participating lenders who may be able to provide financing.
• Contact you about your inquiry and respond to questions.
• Send transactional confirmations and service-related messages.
• Maintain records of consent, communications, and opt-out requests.
• Detect, prevent, and investigate fraud, abuse, or misuse of the Site.
• Comply with legal obligations and enforce our Terms of Service.

4. How We Share Your Information (GLBA Disclosure)

Consistent with GLBA and its implementing regulations, we disclose nonpublic personal information as described below.

• Participating lenders — we share the information you submit through our inquiry form with one or more participating hard money lenders so that they can evaluate your request and contact you about financing.
• Service providers — we share information with vendors that help us operate the Site, including hosting, analytics, email delivery, customer relationship management, spam and fraud prevention, and communications platforms, under contracts that restrict use of the information to the services they provide to us.
• Legal and safety — we may disclose information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, the safety of others, or to investigate fraud.
• Business transfers — if we are involved in a merger, acquisition, reorganization, sale of assets, or bankruptcy, information may be transferred as part of that transaction, subject to customary confidentiality protections.

5. Your Right to Limit Sharing

By submitting an inquiry through the Site, you authorize us to share the information you provide with one or more participating lenders so they can contact you about financing. This sharing is a core part of the service you are requesting, so if you do not want your information shared with participating lenders, please do not submit an inquiry.

You can limit further marketing contact from us or from participating lenders at any time by:

• Emailing us at [email protected] with "Opt Out" in the subject line.
• Calling us at 408-886-9962 and requesting to be removed from marketing contact.
• Replying STOP to any marketing text message you receive to stop further text messages from that sender.
• Following the unsubscribe instructions included in any marketing email.

Please note that opting out of marketing does not stop transactional messages related to an inquiry you submitted, and opt-out requests must be directed to each participating lender you wish to stop hearing from.

6. Data Security

Consistent with the GLBA Safeguards Rule, we maintain an information security program with administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of the nonpublic personal information we collect. Our program includes access controls, encryption of sensitive data in transit, vendor due diligence, employee awareness practices, and periodic review of risks and controls.

No method of transmission over the internet or electronic storage is completely secure. While we work to protect your information, we cannot guarantee absolute security.

7. Your Choices

You may exercise the following choices regarding your information:

• Access — request a copy of the personal information we maintain about you.
• Correction — ask us to correct information that is inaccurate or incomplete.
• Deletion — request that we delete information we maintain about you, subject to our legal and recordkeeping obligations.
• SMS opt-out — reply STOP to any text message from us or a participating lender to stop text messages from that sender.
• Phone opt-out — tell any caller to add you to their internal do-not-call list, or contact us directly to stop phone calls from us.
• Email opt-out — use the unsubscribe link in marketing emails or email us to stop marketing emails.

8. Children's Privacy

This Site is not directed to children under 13 years of age, and we do not knowingly collect personal information from children.
